The FEMA 50% Rule in Naples and Collier County

The rule that can turn a big remodel into a bigger one, explained without the acronyms, and how we check it before pricing your job.

What the rule says

If your home is in a special flood hazard area and the cost of improvements reaches 50% of the building's market value (the building, not the land), the whole structure must be brought up to current flood rules, which usually means elevating it. It is a federal rule applied locally, and the local part is what matters.

City of Naples versus unincorporated Collier

Because the two offices count past work differently, the same remodel can land on different sides of the line depending on your address. Your tax bill says which jurisdiction you are in.

How we check it at the estimate

  1. We confirm your jurisdiction and flood zone from the address.
  2. We pull the building value from the Collier County Property Appraiser.
  3. We total your planned work, plus any past permitted work the city or county still counts under its current rule.
  4. The result goes into your estimate in writing, with the margin to the 50% line.

If you are close to the line we say so before you choose finishes, because a different scope can keep you under it.

What this page is not

Not legal or engineering advice, and not the jurisdiction's own determination. The city or county makes the final call when the permit is reviewed. We recheck the city and county rules before every estimate, because they change.

FAQ

Questions Naples owners ask

What is the FEMA 50% rule, and could my remodel trigger it?
If your home is in a flood zone and improvements reach 50% of the building's value, the structure must meet current flood rules. The City of Naples and unincorporated Collier County count past work differently, and the city changed its rule in December 2024. We check your address against the current rule before pricing.
Is my address City of Naples or unincorporated Collier?
Your property tax bill says. Roughly, the older coastal core is the city and most of the rest is the county. We confirm it at the walkthrough.
Does a kitchen remodel count?
Yes, every permitted improvement counts toward the total. A single kitchen rarely reaches 50% on its own, but past permitted work can be added to it, depending on the current city or county rule.
